1. Acceptance of terms; who you're contracting with

petz.zone (the "Platform" or the "Service") is a service and trade name owned and operated directly by 3-101-955330 SOCIEDAD ANÓNIMA, a company duly incorporated and registered under the laws of the Republic of Costa Rica, corporate identification number (cédula jurídica) 3-101-955330, domiciled in San Pedro de Montes de Oca, San José, Costa Rica, trading as "ABChainD Systems" ("ABChainD", "we", or "us"). petz.zone has no separate legal personality — the party you're contracting with, and the only party obligated to you, is ABChainD.

These Terms of Service (the "Terms") form an adhesion contract between you and ABChainD. You accept them by checking the acceptance box when creating a guardian account. That electronic acceptance is fully valid under Costa Rica's Law No. 8454 on Digital Certificates, Signatures, and Electronic Documents, and we retain a record of the date, time, and version you accepted.

Consent to process your personal data is given separately, per the Privacy Policy. If you do not agree with these Terms, please do not use petz.zone.

2. Eligibility

To create a guardian account, you must:

  • have reached the age of majority: eighteen (18) under Costa Rican law, or the higher age set by the law of your country of residence;
  • have the legal capacity to accept these Terms.

This requirement applies to every role, including Sitter. At signup, you declare you meet it; if that declaration proves false, we may close your account and delete your data.

petz.zone accounts are for humans managing pet profiles — pets themselves are not account holders. We do not offer parental/legal-representative-consent account creation for minors.

3. Accounts and guardianship

  • You are responsible for keeping your account credentials secure and for all activity under your account. If you suspect unauthorized access, notify us immediately at legal@petz.zone.
  • A pet's profile can have multiple guardians, each with a role determining what they can do:
    • Owner — post as the pet and edit the profile.
    • Guardian — post as the pet and edit the profile.
    • Sitter — view only.
  • The Owner is responsible for deciding who else is granted access to the pet's profile.
  • You represent that you have a legitimate relationship with the pets whose profiles you manage. ABChainD does not determine animal ownership or custody. In the event of a disagreement between guardians, the Owner's decisions prevail within the Platform, without prejudice to whatever a competent authority decides.
  • If an Owner deletes their account, a pet profile with other guardians remains with them; a pet profile guarded solely by the deleted account is deleted (see Privacy Policy §8).
  • You agree to provide accurate information about yourself. Pet information (species, breed, age, bio) is self-reported in good faith by the guardians themselves.

4. Content ownership and license

  • You retain ownership of the photos and other content you upload, along with your moral rights under Law No. 6683 on Copyright and Related Rights.
  • By posting content, you grant ABChainD a non-exclusive, royalty-free, worldwide license, sublicensable only to our data processors, to host, store (including via IPFS — see Privacy Policy §6), technically reproduce, display, and distribute that content solely to operate and provide the Service.
  • This license ends when you delete the content or your account, except for:
    • (i) copies independent third parties obtained of public content, which are outside our control;
    • (ii) copies we must retain under a legal obligation or a competent authority's order.
  • You warrant you hold the necessary rights to the content you post. If it shows an identifiable person, you warrant you have their consent (Código Civil Art. 47). If that person is a minor, you warrant you have their parent's or legal representative's consent.
  • Public content and IPFS. Once content is shared publicly, third parties outside ABChainD's control may obtain copies of it, so removal from every possible copy cannot be guaranteed (see Privacy Policy §6). The Platform will show you this notice and require your express confirmation before your first public post, and every time you switch a profile from private to public. This notice describes a technical limitation and is not a waiver of your rights under Ley 8968, which ABChainD will fully honor for all data and copies under its control. Think before posting something you might later want to fully retract.

5. Acceptable use

You agree not to post or engage in:

  • illegal content, harassment, hate speech, or any sexual content involving minors — zero tolerance: such content is removed and reported immediately to the competent authorities where the law requires it;
  • content promoting animal cruelty (Costa Rica's Animal Welfare Law No. 7451 and the Penal Code reforms under Law No. 9458), animal fighting, or illegal breeding;
  • content promoting the illegal keeping, hunting, or trade of wildlife (Wildlife Conservation Law No. 7317);
  • impersonation of another person, pet, or organization;
  • posting another person's images or personal data without their consent, including disclosing home addresses or other location data (doxxing);
  • spam, automated/bot abuse, mass scraping, or distributing malicious code;
  • attempts to bypass a pet profile's guardian-role permissions (e.g., posting as a pet you are not an authorized guardian of).

6. No professional advice

petz.zone may help you connect with veterinarians, trainers, groomers, and other members of the pet-care community, but petz.zone itself does not provide veterinary, medical, or professional advice of any kind.

Information shared by other users — including anyone self-identifying as a "vet" or "trainer" — is not verified by ABChainD and should never replace consultation with a licensed professional, such as a veterinarian duly registered with Costa Rica's Colegio de Médicos Veterinarios. In a pet health emergency, contact a veterinarian immediately.

7. Reporting and moderation

  • We provide tools to report content or accounts that violate these Terms.
  • Where these Terms or the law are violated, we may remove content, restrict features, or suspend or terminate an account. These measures apply only in response to an actual violation, proportionate to its severity, and per our moderation process.
  • Unless content is manifestly illegal or poses an urgent risk, we'll notify you of the measure and its reason, and you may request review by writing to legal@petz.zone.
  • Copyright. If you believe content infringes your copyright, send a notice to legal@petz.zone containing the information required under the service-provider liability safe harbor regulation (Executive Decree No. 36880-COMEX-JP).

8. Termination

  • You may delete your account at any time (see Privacy Policy §§8, 10).
  • We may suspend or close your account only if you violate these Terms or the law, per §7.
  • If we decide to discontinue the Service entirely, we'll give you at least thirty (30) calendar days' notice, during which you may export your content.

9. Scope of liability

9.1. Our commitment. ABChainD will provide the Service with the reasonable diligence expected of a service of this nature. The Service is offered free of charge and in its current stage of development, so it may experience interruptions or feature changes.

9.2. Matters outside ABChainD's control. Subject to §9.3, ABChainD is not liable for damages arising from:

  • (a) content posted by other users;
  • (b) information or recommendations from other users (see §6);
  • (c) copies of public content obtained by independent third parties (see §4);
  • (d) interruptions for scheduled, previously announced maintenance;
  • (e) force majeure, an act of a third party, or the affected person's own fault.

9.3. Rights that are never limited. Nothing in these Terms excludes or limits:

  • (i) ABChainD's liability for fraud or gross negligence;
  • (ii) liability for harm to life, health, or personal integrity;
  • (iii) any right that Costa Rica's Consumer Protection Law No. 7472, Ley 8968, or any other mandatory rule grants you on a non-waivable basis.

10. Indemnification

You agree to compensate ABChainD for duly proven damages caused by your culpable breach of these Terms or unlawful use of the Service. This includes third-party claims arising from content you post, to the extent determined by a competent authority and within the limits of applicable law.

11. Governing law and disputes

  • These Terms are governed by the laws of the Republic of Costa Rica.
  • Disputes are subject to the courts with competence under the Código Procesal Civil (Law No. 9342).
  • If you are a consumer domiciled in Costa Rica, you may bring proceedings, at your choice, before the courts of your domicile or of San José. Any proceeding ABChainD brings against you will be filed in the courts of your domicile.
  • Nothing in this clause waives your procedural rights, nor does it limit your right to file a complaint with the Comisión Nacional del Consumidor (Costa Rica's Ministry of Economy, Industry, and Commerce) or with PRODHAB, nor any protection granted to you by the mandatory law of your country of residence.

12. Changes to these terms

  • We'll notify you of any substantial change to these Terms by email and within the Platform, at least thirty (30) calendar days before it takes effect, and update the effective date.
  • Substantial changes require your express acceptance, requested at your next login after the change takes effect; your silence will not be treated as acceptance.
  • If you disagree, you may delete your account at no cost before the change takes effect.
  • Changes are never retroactive.
  • Formal corrections and legally-mandated adjustments take effect upon publication.

14. General provisions

14.1. Language. These Terms are published in English and in Spanish (TERMINOS-DE-SERVICIO.md). For users domiciled in Costa Rica, the Spanish version controls in case of any discrepancy.

14.2. Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in full effect.

14.3. Assignment. ABChainD may assign its position under these Terms as part of a corporate reorganization (e.g., merger or transfer of the Service), upon notice to you. Your data is then handled per Privacy Policy §7.

14.4. Notices. Notices between you and ABChainD are given electronically: to your account's registered email, or to legal@petz.zone.

14.5. Entire agreement. These Terms, together with the Privacy Policy, form the entire agreement between you and ABChainD regarding the Service.

14.6. No waiver by forbearance. ABChainD's failure to enforce a provision at any given time is not a waiver of it.
